Introduction

These Terms and Conditions of Sale (hereinafter referred to as the “Terms”) govern the sale of products and services by Primal Perform LLC, a company registered in the United States, with its principal office at:

Primal Perform LLC specializes in the sale of fitness-related products, including pre-workouts and gym supplements, as well as providing coaching appointment scheduling services (hereinafter referred to collectively as the “Products and Services”).

These Terms apply to all purchases made by customers (hereinafter referred to as the “Customer”) on the Primal Perform LLC website or through any authorized sales channel. By placing an order, the Customer agrees to be bound by these Terms.

Description of Products and Services

Products
Primal Perform LLC offers a range of fitness-related products, including but not limited to pre-workout supplements and gym-related nutritional products (hereinafter referred to as the “Products”). These Products are intended for fitness enthusiasts and individuals pursuing a healthy and active lifestyle. Primal Perform LLC ensures that the Products meet high-quality standards, but Customers are responsible for ensuring the Products are suitable for their personal use.
Coaching Services
Primal Perform LLC also provides coaching services, which include fitness consultations, training sessions, and related activities. Appointments for these services must be scheduled in advance using the available booking tools.
- Cancellation and Refund Policy
  Coaching appointments may be canceled or rescheduled by the Customer up to 24 hours before the scheduled session. Cancellations made within less than 24 hours of the appointment time are non-refundable. Similarly, if a Customer fails to attend a scheduled session without prior cancellation (“no-show”), no refund will be issued.

Order and Payment Terms

Placing an Order
Orders for Products and Services offered by Primal Perform LLC can be placed through the official website or any authorized sales channel. All orders are subject to availability and confirmation of payment.
Accepted Payment Methods
Primal Perform LLC accepts the following payment methods:
- Major credit and debit cards (Visa, MasterCard, American Express, etc.)
- PayPal

All payments must be completed in full at the time of order placement. Orders will not be processed until payment has been successfully received.

Order Processing and Shipping
- Orders for Products will be processed within 48 hours of payment confirmation, excluding weekends and public holidays.
- Primal Perform LLC ships exclusively within the United States. Delivery times may vary depending on the destination and the shipping method selected during checkout.
Order Cancellations and Modifications
- Orders can only be canceled or modified prior to shipping. Once the order has been shipped, cancellations or changes are no longer possible.
- If an order cannot be fulfilled due to stock unavailability or other issues, Primal Perform LLC will contact the Customer to offer alternatives or issue a full refund.

Return and Refund Policy

Product Returns
Primal Perform LLC accepts returns of Products under the following conditions:
- The Product must be unused, unopened, and in its original packaging.
- The return request must be made within 14 days of the delivery date.

To initiate a return, Customers must contact Primal Perform LLC at contact@primal-perform.com to receive return instructions. The Customer is responsible for the cost of return shipping unless the return is due to a defect or error on the part of Primal Perform LLC.

Refunds
Refunds for returned Products will be issued as store credits only, which can be used for future purchases on the Primal Perform LLC website. No cash or card refunds will be provided unless required by law.
Non-Returnable Items
The following items are not eligible for return:
- Products that have been opened, used, or are not in their original packaging.
- Coaching services, as they are subject to a separate cancellation policy outlined above.

Warranties and Limitation of Liability

Product Disclaimer
The Products offered by Primal Perform LLC are intended for fitness and nutritional support and are not designed to diagnose, treat, cure, or prevent any disease. Customers are responsible for consulting a healthcare professional before using any supplement, especially if they have pre-existing medical conditions or are taking medications.

Primal Perform LLC makes no guarantees regarding the specific results that may be achieved through the use of its Products, as individual results may vary.

Customer Responsibility
By purchasing Products or Services, Customers acknowledge that they are responsible for the appropriate use of these items. Coaching Services are provided as general guidance and are not intended to replace professional medical or fitness advice.
Limitation of Liability
To the maximum extent permitted by law, Primal Perform LLC shall not be held liable for:
- Indirect, incidental, or consequential damages arising from the use or inability to use the Products or Services.
- Injuries, health issues, or damages resulting from improper use of the Products or Services.

Primal Perform LLC’s total liability for any claim shall not exceed the amount paid by the Customer for the Product or Service in question.

General Provisions

Governing Law and Jurisdiction
These Terms and Conditions of Sale are governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Florida.
Amendments to the Terms
Primal Perform LLC reserves the right to amend or update these Terms at any time without prior notice. The updated Terms will be published on the Primal Perform LLC website and will apply to all transactions made after their publication. Customers are encouraged to review the Terms regularly to stay informed of any changes.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with any additional policies referenced herein, constitute the entire agreement between Primal Perform LLC and the Customer and supersede all prior agreements, communications, or understandings, whether written or oral, regarding the subject matter hereof.
